The Plenary of the Consejo de la Judicatura (CJ) has unanimously dismissed J.E.R.M., a former judge from Yaguachi in Guayas province, for the third time. The decision relates to actions taken by the ex-judge in 2023, when he granted precautionary measures that restored the political rights of former Vice President Jorge Glas.
In 2023, J.E.R.M. ordered that the National Electoral Council (CNE) be informed of his decision, lifted restrictions preventing Glas from holding public office, and directed that this information be communicated to the Ministry of Labor.
At that time, Glas had final convictions for crimes including illicit association and bribery. Despite these convictions, J.E.R.M. issued rulings favoring Glas’s ability to participate in public life.
According to CJ authorities, this conduct violated the third paragraph of Article 27 of the Organic Law on Jurisdictional Guarantees and Constitutional Control and constituted a serious offense defined as “inexcusable error” under Article 109.7 of the Organic Code of Judicial Function.
Although J.E.R.M. is no longer part of the judicial service, CJ officials explained that issuing multiple dismissals ensures that if he challenges his removal through administrative or constitutional means, he would need to overturn all three dismissals—not just one—making it more difficult for him to return to judicial duties.
